Falae’s son’s widow sues airline for $100,000


The family of ex-Ondo State Commissioner for Culture and Tourism, the late Deji Falae, has urged the Federal High Court in Lagos to hold that Associated Aviation Nigeria Ltd and Nigeria Civil Aviation Authority (NCAA) caused his death through negligence.
The deceased, a commissioner, was a passenger on board Flight 361, which crashed on October 3, 2013 while taking the remains of former Ondo State Governor Olusegun Agagu to Akure, the Ondo State capital.
The late Falae’s wife, Ese and three teenage children are claiming damages from the defendants for alleged negligence.
They are claiming $100,000 as general damages and N219,906,250, which they said the deceased would have earned in 15 years as a lawyer, commissioner and owner of a construction firm.
The plaintiffs sought, in the alternative, N108,527,750, £160,740 and $19,000 as special damages for alleged breaches of the defendants’ duties under the Civil Aviation Act 2006, Fatal Accident Act 1846 and Fatal Accident Law of Lagos State.
They asked for N5million as cost of filing the suit and legal fees, and 10 per cent interest on the post-judgment sum.
The family claims Associated Aviation, which operated the chartered aircraft, breached Section 74 of the Civil Aviation Act 2006 by failing to procure a legally binding insurance policy covering its liabilities, including compensation for damages that may be sustained by third parties.
It urged the court to hold that the company breached statutory duties imposed by Section 55 of the Act when its aircraft crashed just outside the aerodrome and caused the deceased’s death, about 9:32 a.m., a minute after take-off.
“The first defendant flew its Flight 361 in such a manner as to cause danger to the occupiers of the aircraft and indeed caused the death of the deceased.
“The only inference that can be drawn from the circumstances of this incident is that the first defendant was negligent and/or lax in carrying out its duties to the occupiers of the flight,” the plaintiff said.
According to the family, the NCAA failed in its duties to ensure that the aircraft was safe to fly.
“By virtue of Section 31 (f) of the Civil Aviation Act 2006, the second defendant has a statutory duty to ensure efficiency and regularity of air navigation and the safety of aircraft, persons and property carried in the aircraft and for preventing it from endangering persons and property,” it said.
But the defendants are praying the court to dismiss the suit.
NCAA said the aircraft was airworthy as at the time of the crash, with a valid certificate of air worthiness.
“The investigation conducted by the Accident Investigation Bureau did not indict the second defendant (NCAA),” it said.
It added that the aircraft was insured at the time of the crash.
“The aircraft was used for charter and while on ground, required routine maintenance was carried out,” NCAA said.
Justice Hadiza Shagari adjourned till July 10 for adoption of addresses.

Aisha Buhari to Chibok girls: Forget the past, acquire skills


The wife of the President, Aisha Buhari, on Wednesday pledged her support in the resettlement of the recently rescued Chibok school girls.
She also advised them to forget the past and acquire skills to be self-reliant.
Aisha made these remarks during her meeting with the 82 freed Chibok school girls in Abuja. She was accompanied by the Minister of Information Alhaji Lai Mohammed and Minister of Women’s Affairs, Sen. Jummai Alhassan.
Also at the meeting were the wife of the Vice-President, Mrs Dolapo Osinbajo, Senior Special Assistant to the President, Dr Hajo Sani, and some wives of state governors.
Aisha urged the girls to also focus on their education as soon as they were reintegrated into the society.
“When you were away, we cried and prayed with your parents for your safe return,” she said.
“It gladdens my heart that after years of hoping, crying and praying, 82 of our Chibok daughters are out of captivity. I am still hopeful that the rest of the abducted girls will also return safe and sound, ” she said.
Aisha, who prayed for the safe return of the remaining girls, assured them that their future would be bright and presented gifts to them.
The wife of the president expressed gratitude to relevant agencies involved in the release of the girls.
On her part, the wife of the Vice-President, Mrs Dolapo Osinbajo, expressed her happiness for the safe return of the girls.
Senator Alhassan, the Women’s Affairs minister, said that the girls would be reintegrated back to the society after they had undergone psycho-therapy.
Alhassan also said that the government made provision for skill acquisition for the girls to enable them earn a decent living.
The minister thanked President Muhammadu Buhari for his serious commitment towards the recovery of the girls.
Alhaji Lai Mohammed said: “What is paramount to us is the release of the remaining girls”.
The minister also assured the girls that in a matter of days, they would be reunited with their families.
“We will take care of you physically and psychologically,” he said.
Responding on behalf of her colleagues, Miss Rhoda Chibok, thanked the federal government for ensuring their safe return and appealed for the rescue of all Nigerians held in captivity by the insurgents. (NAN)

Biafra: I will obey former Vice President, Ekwueme – Nnamdi Kanu















Former Vice President, Chief Dr. Alex Ekwueme, Wednesday, assured of his fatherly support to the leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu.
Ekwueme made the pledge when the IPOB leader visited him at his Enugu residence, with a promise that he would listen to advice from the elder statesman.
Kanu has since he was released being paying thank-you visit to prominent persons and organizations, with a vow that he would never give up on Biafra.
He had told Ekwueme that “I have come to tell you that we find you invaluable in our advancement of our people and in our course also to make life better for the public and for the masses.
“So, I am humbled and delighted to be here and also to bring you up to speed as to what we have been doing, what motivated me; what motivated the IPOB to do what we have been doing.
“It is more or less today an expression, a political expression to the yearnings and aspirations of the society; that’s what we are trying to do.
“The sum total of the struggle by the IPOB, which I’m leading is to ensure that there is dignity of life.
“And for us to fulfill that very mandate, we must be diligent, we must be focused, we must be sincere.
“So, I have come here to brief my father as to why we‎ do what we do and to get his blessings; anything he tells me is what we are going to do, in so far as it advances our political course as a people.”
Responding, Ekwueme said it was a pleasure receiving the IPOB leader after all his travails, stressing “I thank God that he is free and able to move around.”
“I will make my best counsel available to him in his very onerous task of leading an organization that is committed to bringing justice and equity among people, especially for our people”, he added.
SPlENSIZY recalls that the IPOB leader had on Monday visited several persons and groups in Enugu, including the Eastern Consultative Assembly, ECA.
The former Vice President, Ekwueme, is a patron of the ‎ECA.
